Is it legal to give prescription drugs to a person they were not prescribed for?

Postby nicolas » Sat Dec 17, 2011 2:29 pm

Joe has a prescription for medicine to treat severe headaches. It is non narcotic but it is a controlled substance. Joe's friend Charlie has a terrible headache and Joe give Charlie some of his own medication. Can Joe be charged with a crime? Please provide any state or federal statutes that may be applicable. Texas state laws in particular.

Yes. If it is a controlled substance, it is a felony. If it is a schedule drug, it is a misdemeanor

Technically yes, it is illegal. If Charlie gets searched by an officer for any reason ( say he gets pulled over) and has it in his pocket, he could very well go to jail for it. Even if its supposedly for a headache. For all the officer knows he is a "pill head" or a "dealer" and he is lying to get out of trouble.

Aside from the legal end...
giving another person prescription medication is a serious risk to the person taking it. A dr. has their medical history, including possible medical harm such as allergy or contraindications.
What "works" for one person can be deadly to someone else.
