Is it legal to take something back from someone when you paid for it?

2. 1/2 years ago a neighbor told us we could have a bus if we paid 250.00 to have it towed to our property all he wanted was the motor and the transmission, which he never came and removed. Now he is in financial trouble with the IRS and he said he wants the whole bus back. He told us a couple of years is good enough for us to have it, yet that was not the agreement. we have nothing in writing, yet I thought possession was 9/10th of the law. He holds no title to this bus. He has told us that he wants to come get it by August 1st 2012, Does he have a legal right to just come take it away from us. all our personal effects are in there and we have no place else to put them.

Final sales are not refundable, as long as you can prove it.

On the meanwhile he can't trespass into your property. And he can't steal your bus. He would need to go to court and fight for the bus.

On August 1st, if he puts a foot into your property call police and file charges for trespassing and attempted burglary.

It would be better if you had some sort of documentation (receipt, cancelled check, etc.) of your paying the 250.00 to him, but I'll bet that does not exist.

If you want, you can refuse to allow him on your property. He can then decide if he wants to take you to court to get the bus back, but he would have to produce a title or similar proof of ownership, and also would have to explain to the court why you've had it for 2.5 years now if he is claiming ownership. I don't think he would win that one.

I think, and i have no basis for thinking this so you will have to go to your local authority, that because he has no record of it, and you have no record of the purchase, that you can at the very least keep him from removing it from your property. if it has sat in your yard for 2.5 years and only now wants to get it, and your things are in it, then there should be something that the police can do to keep him from taking your bus.

if he sold it to you as is on his word, that should hold some basis of ownership for you.
