Is it possible to sue for wrongful termination? ?

I live in the state of illinois. I was recently fired from my job while on workers compensation. I went on WC n my office was ok with it n was paying me. Then after 3 weeks of being on WC, my office called me and said I was fired because they needed to fill my position since I didn't know when or how soon I would be able to return back to work from my injury. Im wondering if I have a case n how to go about it n how much do sue for? What's the likelihood of winning? How much would I receive?

Why do ppl wanna sue other people???? Just find a job, work for an honest days pay, and stfu

Employment in all states except Montana is at will. That means you can quit at any time with or without notice and for any reason or no reason at all. It also means they can terminate you for no reason or any reason that does not violate EEOC guidelines.

The only way that you would have a case is if they fired you for discrimination covered by the company hiring contract or your states protection laws. Even then, it has to be proved and is a long shot. For example, if you were fired by your employer finding out you were gay and they told you that they were letting you go because of being gay, you "might" have a case. I say might because many states do not have this protection. However, if it says in your application that sexual orientation is protected by the company or it is protected by state law it was illegal. But, that is hard to prove without a video recording, audio or it being in a letter or an e-mail.

I don't see how you were discriminated against. They can fire you for anything as long as they are smart enough to not tell you why and it was not for discriminatory matters. Plus, court costs are huge. Don't waste the courts time with such stupid matters. Why work for those people if they don't want you? Go elsewhere and put it behind you!

I have the same situation right now as we speak. I am on WC. Do to my injury and amount of time I have had off the company has had to fill my position. If I can get a release to go back to work on temporary light duty there is none. The company probably will have no choice but to let me go. After talking to unemployment because I am not 100% able to work another job I am not able to collect unemployment. The only thing I can do is keep collecting WC until I have a Dr. release to go to work. You should still be able to keep collecting WC until Your Dr. releases you from his care. After that you must be able to work and then you should be able to collect unemployment.

it seems you believe you have some sort of job protection while on comp, as you have found out there is no law that prevents anyone from being let go while on comp, you cant sue the employer for anything.
