Israeli Statute Of Limitations - Negligence (personal Injury)

Postby Garaden » Mon Jun 30, 2014 11:40 pm

Somewhere, during my countless hours of research on this matter, i came upon your very useful website and info.

i am an attorney in new york and i have a case that involves a woman who was injured at a hotel while on vacation in israel(near the Dead Sea); i am trying to determine whether we can bring suit in new york; i have researched issues of jurisdiction, etc. but the major item i need to determine is the applicable statute of limitations in Israel(in case she needs to bring suit there and/or in case the israeli statute of limitations would apply even in a case brought in new york); depending on the answer, this could turn out to be a very time sensitive issue; please let me know what the Israeli statute of limitations for a negligence(personal injury) case is(or where i can look it up easily), as soon as possible.  Thank you very much!!!!!!!!!! -- Cory I. Israeli Statute Of Limitations - Negligence (personal Injury)

Dear Colleague,

I am happy to assist as requested.

I assume that by "the statute of limitations" you relate to the statute assigning the certain time after which rights cannot be enforced by legal action.

If this is what you mean, then the answer is that according to the general Israeli Law(art. 5+6 of the Israeli Statute of Limitations) the limitation is 7(seven) years since the cause of the claim was formed. In your case - 7 years since the date of the injury. Nevertheless, according to the specific laws of personal injury in Israel(art. 89 of the Statute of Torts) in such cases the claim is formed only after the damage have been established(either partly or fully), which may take sometime after the date of injury. If this is the case, the time period of 7 years starts only then - when the damage has been established. A judgement(one of many) well summerizing the above principals is the one that was given by the Supreme Court of Israel in the civil apeal numbered 165/83.

Sincerely Yours,
