I bought a dress on Ebay that was listed as a size 10 although it was described as free size and would suit from a 10 upwards. No measurements were given. I'm certain that this dress is at least a size 14 after measuring the bust/waist and it's completely unwearable as a true size 10.

Can I open a dispute over this or should I have taken more notice of it being free size despite it being listed as a size 10 in the item specifics?

The seller states no refunds (we're both Australian and this is incorrect under consumer law) and I was overseas for the past few weeks so I literally only have 1 day to open a case and likely wouldn't receive a reply in time if I messaged the seller.

If you're a size 10, and the item states that it is a size 10 (free size) it should still fit you as a size 10.

Your options are: 1) contact the seller, they'll probably be unsympathetic.. 2) contact ebay resolution team, they'll more than likely help you. They've been really helpful to me in the past. 3) Sell it yourself on ebay, or try and contact the 2nd highest bidder, see if they'll buy it off you, you might lose a little bit but..?

If it says size 10 on the label then I think you can only get a refund if they are a business seller due to distance selling regulations and can say it was a 'change of mind', but it has to have been bought on 'buyitnow' not an auction and within 7 days.

If it says size 14 on the label you can open a case for 'item not as described', you will have to return the dress to the seller and get a refund, I'm unsure if you get postage refunded as well though.

If a private seller you can only get a refund if it was a different size to stated.


This is for the Uk though, not sure if it's the same overseas.

Okay. First lesson - always ask questions before bidding. The seller should have posted measurements, and that's the first thing I would have asked for before bidding. The size 10 was input possibly because the seller didn't know how to post free size instead. Sounds like a very inexperienced or uncaring seller. Since it stated free size you may have a problem with the claim, but I would contact the seller and state that it is not suitable for a size 10, it's way too big, and see what the reply is. They may be gracious and let you return it ( I post no returns as well because I don't want buyer remorse to be flooding my mailbox with returns for products that there is nothing wrong with !!!) anyway. You can also open the case, and explain to the seller why you did so, because you have only 1 day left to do this. If the seller is uncooperative, then you have the case open and then it's up to ebay to decide.
