Judgements And Wage Garnishments

Postby ariyn » Sat Dec 21, 2013 1:12 am

When filing Chapter 7 Bankruptcy, does this stop wage garnishments? Will it stop a judgement from becoming a wage garnishment?

Judgements And Wage Garnishments

Postby Kelvan » Sun Feb 23, 2014 12:12 am

that depends on the kind of judgment being garnished....if it's for child-support or fees, then, No. If it's for a civil judgment for injuries or financing or unsecured debt, then, yes, a request for protection under Section 7 must end the garnishment....at-least thatis my experience from dealing with bankruptcy attorneys for more than 15 years...but my newest experience isn't in consumer bankruptcy, therefore Iam not "present" on the brand new regulation changes.
