Law enforcement jurisdiction question....?

Postby baigh » Sat Apr 02, 2011 11:25 am

In Missouri, what gives law enforcement jurisdiction on private land? An anonymous phone call or written consent? If so, are they allowed to give traffic citations on private property?

Law enforcement jurisdiction question....?

Postby chiram97 » Sat Apr 02, 2011 11:35 am

Any public official can enter private property on official business. This applies to land only, not dwellings.

Being on private property does not exempt you from criminal law, but it does exempt you from most traffic laws. There are some traffic laws that are enforced on private property that is open to the public, such as a shopping mall parking lot. Examples would be handicapped parking, blocking a fire lane, or reporting an accident.

Law enforcement jurisdiction question....?

I can give tickets on private property if the city has an ordinance that covers the area or violation in question.

For instance, almost all handicapped parking citations or fire lane violations are written on private property.

Domestic Violence calls, burglaries, peace disturbances, and many other calls all take place on private property. I investigate and make arrests for many of these crimes.

Law enforcement jurisdiction question....?

The varies from state to state. In most cases, law enforcement does not issue "citations" on private property unless the infraction was committed on public land. However, traffic crimes such as driving under the influence are enforced on private property. Cops can go on to private property if they have probable cause to think a crime is being committed.
