Lawyer Refused To File Post Trial Motion

Postby Antoine » Sat Jun 07, 2014 7:39 pm

What options are available to a plaintiff when their lawyer failed to file a post trial motion?  The plaintiff repeatedly objected to some of the issues(ie: jury foreman employed by defendant) and begged the attorney to exercise other options but he didn’t even mention the possibility of a post trial motion when the jury ruled in defendants favor in a premise liability, personal injury case.

Lawyer Refused To File Post Trial Motion

There is a time limit to file post-trial motions.  If the time limit has not expired, you could approach other lawyers about taking over the case and filing the motions.  Honestly, I doubt you'll find any lawyers who will agree to do that.

You could file the motions pro se - which means you will represent yourself.

You could consult with a lawyer who handles legal malpractice cases to determine if your lawyer committed malpractice.
