I was layed off yesterday, and have no faith that the company will properly pay me. How long will I have to wait to file a claim with the U.S. dept. of labor wage and hour.  The next question is: I was a salary employee do they have to pay for the full week or do they only pay for the partial week?

ANSWER: You have to be paid for the whole week. You need to wait until after the deadline for the company to pay you. Different states have different rules. If you let me know which state you are in I can look your state rules up on paying upon layoff.

State law requires the employer to pay an employee all wages due him or her within 48 hours of the day of separation OR the next regularly-scheduled payday, not to exceed 30 days

This is the State of South Carolina. The State of South Carolina law is in effect because that is where the work is performed. You will also file for unemployment in the state of South Carolina.
