Legally what can I do when my car gets blocked in by other cars: Massachusetts?

Postby kendell » Sat May 12, 2012 12:22 pm

This happened to me this morning and legally I wasn't sure if I could do anything.

Setup. I parked on a public street and can to park anywhere as long as I don't block a driveway or where there is a town permit sign saying no parking. The place I park in is the space before of these sign where only a resident of that property can park.

The issue. When I came outside to my spot, a car pulled up to my bumper facing the same direction as me and the other guy facing the other direction pulled up to front bumper. Now after bumping them few times, I was able to get out with no damage to any cars but legally if I did do damage I'm sure I would of been at fault (correct me if I'm wrong). I am not sure if there any legal ways I could of got the car moved if this happens again. Also, I once heard parking facing the opposite way of how the traffic moves on that side of the road is against the law but I can not find any facts about that, someone know where this is stated or how to locate if this is true?

About the only thing you can do is call the police or parking athority (of your city/town has one). They will come give out tickets or tow the cars away. It might take them some time to get to you, so if you are in a rush it might not be a good option. It is illegal to park opposite traffic in MA (I've got a ticket for it myself) and you also have to leave room for the cars around you to pull out. So both people would at least get tickets for it. Good luck!

It is not usually possible to "have someone towed" for parking a car facing the wrong direction as it is not considered an "immediate hazard" or nuisance. They could be cited, but there is no way for the parking enforcers to know which of the cars "blocked" you in, so they might skip that part.

It is illegal to drive on the wrong side of the road. You could have called the town and had the car towed. However, there is really nothing to do to stop people from parking too close to you, because nobody knows who parked when. You may have chosen to park too close to one car, and the other came in after.

Incidentally, you do know that by 'bumping them a few times' and leaving, you committed an offence? That is hit and run, leaving the scene of an accident. If you TOUCH another car, you must at a minimum leave a note.
