First off there is a lot to consider BEFORE you take legal action.
Are you sure that the infection was not already present in your husband. Was the infection during surgery or after? Did your husband use proper sternal precautions after surgery.
The reason I ask these questions are because Staph is considered normal fluora, in other words we have bacterial that live on our skin. No matter how clean we are it is still there. It typically causes no harm unless we injure our selves, or unless our systems are weakened.
It is possible that the infection could have been present and contributing to your husbands condition prior to surgery. (You did not say why he needed surgery.)
Post surgical infections though rare can and do occure. that is why we treat our patients post surgery with IV antibiotics.
I ask about sternal precautions because the incidence for post surgical infections of cardiac patients is considerably higher for patients that do not adhear to sternal precautions.
Now once you have considered the above and you still feel that there was negligance on the part of the hospital or staff or surgon then I would say that you should speak with the local Bar association for your state and ask them for a list of aattourneys that handle medical malpractice cases. The ones worth the time to consult will have a Legal Nurse Consultant on staff or on retainer that will also help weed through and help to determine if you have a case.
