Malpractice - Should all doctors have Malpractice Insurance?

Postby stein74 » Wed Dec 14, 2011 10:25 am

I got a "Tummy Tuck" two years ago, and my stomach is numb. If you stick me with a needle, I will bleed and not feel any pain. No attorney wants to take my case, can anyone out there help me? Or tell me what should I do?

With the exception of active duty and civilian physicians dealing with active duty (military) personal, all physician practicing in the U.S. have insurance, including malpractice.

But because a "Tummy Tuck" (like Lasix, Bunionectomy etc.) are considered "elective surgery", and you are made to sign a waiver beforehand (which will most likely list numbness, amongst other things like death etc.), it makes it impossible to get a malpractice suit, because that would require you to show that something in the procedure of the physician was beyond the usual, extremely neglectful or willful.

It's difficult (at this time) but not impossible, make your voice heard and find others that have suffered a similar problem.
