Medical-Malpractice - Can we do any legal actions against his work place and/or the doctor at his work place?

Postby tanishia » Tue Dec 13, 2011 8:01 pm

My dad arm was hurting at work so he went to a nurse at the work place; the nurse sent him to a doctor, the doctor gave him some medications for the pain hes having on his arm. After several days of taking the medicine, one day he went to work and he fainted while walking up some steps. The work place called an ambulance and took him to the hospital. He pooped out blood and threw up blood. His liver is damaged due to the medication at his work gave him. Can we do any legal actions against his work place and/or the doctor at his work place?

No. ANy possible action (and this is doubtful) would be against the drug maker. The doctor isn't responsible for side effects. Attitudes like yours are why our legal system is so bloated and broken. Everyone else isn't always to blame for when life hands you crap.

If the dosage of the medication was prescribed correctly and the doctor was not doing anything unreasonable like any doctor would do for his pain, then there is nothing you can do. It would be extremely hard to prove this medication did the damage at all since the liver is really a tough organ that can take a lot of abuse. There could be some underlying problem affecting his liver that has been going on for a long time without his knowledge. I had no idea I had a liver disease (cirrhosis) until my liver was already 90% destroyed. No symptoms showed up until then. In a lawsuit, you would have to prove that his liver had no damage before taking that medication and they are going to argue that it did. You have the burden of proof to win a lawsuit.
