Had a minor accident yesterday coming home. I was in the right lane almost to a stop light, had my left turn signal and was starting to get into the left lane. Woman behind me decided that she wants to merge and get ahead of me before I merge. Doing so the side of our cars scraped a little and a little ink came off her cars sign on the right side but no body damage other than a little paint damage. Nothing to my car. Called the police and Virginia state trooper came and dealt with the situation. He listened to my story and hers. I told him she was behind me and I started to merge, she wasn't there when I started to merge. He looked at the damage took both our information and moved us to a new location up the road away from traffic. After waiting some more he told me that because she moved into the other lane and I wasn't fully in the other lane it was my fault. I did not receive a accident report or police report of which I asked for. I also asked for her insurance information to have on file and he didn't give that to me either nor did she at the accident. I was given one ticked for "failure to yield right a way" Virginia statue 46.2-820. I had one person in the car that was with me and told the officer she was behind me when I was merging over and then tried to zoom around me. Not sure what to do now! I didn't get a accident report/police report, her insurance information and I'm almost positive that the officer said that he didn't file one because it wasn't anything really. I do know that he gave the lady my insurance information though. I'm confused about all this and so is my insurance company I believe. Also the statue cited on my ticket says cars on the left failing to yield right a way to car on the right at uncontrolled intersection. I was on the right trying to get to the left lane and almost at a stop light. Any thoughts?
