Missouri tenant laws?

Postby adusa37 » Wed Oct 26, 2011 1:36 pm

I'm getting ready to move out of my apart and move into a house i bought, let me start off by saying i know to hand the property over to the complex the same way you received it minus wear, my question is the complex is tearing all there carpets out of there apartments so is it right for someone to charge me 75 dollars out of my deposit for a carpet clean they never even did because they rip the carpets up and laid down hard wood floors,the carpets are not really that dirty mostly traffic areas. Can i recover my money some how?

It depends on how long you've been there. For example, after 5-6 years, replacing the carpet is inevitable. You shouldn't be charged. If you were only there for a year or less then yeah - you can expect them to take the $75 out of your deposit. Unless you can prove that your carpet is in excellent condition, it's not worth fighting. You're going to lose that one.

I would fight it if you've been there at least 4 years though.

==EDIT==

The age of the carpet is very relevant. If it was new carpet when you move in, you need to pay up even if they just replace it. If it was worn carpet when you move in, you could have a case to get the charges reversed.

The date you signed the lease does not tell us how old the carpet is.
