My son was hit by a vehicle?

The driver was not the owner and didn't have insurance. Now the owner said he sold vehicle a month before this happened and took car off his insurance. But the car was never transferred out of his name. Who would be responsible for my son's personal injuries?

Well it would be the first owners falt because the car wasnt transferred out his name and didn't have insurance

If the owner can prove he sold the vehicle, the new owner will be the responsible party.

If the original owner can prove that he sold the car ( a bill of sale will do) then he's not responsible. As you know from purchasing a used car...it's the buyers responsibility to put the car in their name. The seller can't force you to do it.

If the car was sold at the time of the collision...then it's the buyer (current owner) who would be responsible.

However, in order to be responsible for your son's injuries....the driver has to be negligent and their negligence the cause of your son's injuries. If your son was the one who is negligent...then you you will have to pay for your son's injuries.

If all you are claiming is medical reimbursement go to your own auto policy and file under the uninsured motorist coverage. You probably have between $20,000 and $50,000 of coverage. It covers all members of the policyholders [family auto policy] family for whatever accident they receive injuries from by an uninsured automobile driver. Check your auto insurance policy for the wording of the coverage. You will find the description in the original forms package received when you first obtained the insurance.
