Can you bring a legal malpractice claim for a Social Security disability case?

Let's say a previous lawyer had completely missed the deadline to appeal a reconsideration denial and request a hearing. Let's say the SSD claim is now res judicata. This also affected the ability to claim additional benefits from a union pension plan.

Can a legal malpractice claim be feasibly brought for missing this deadline? I guess one of the main issues that concerns me is that you have to generally prove you would have otherwise ...

Should the first step to reforming healthcare be tort reform?

One reason healthcare is so expensive and costs keep rising is because malpractice insurance costs are going up as well. With as many frivolous lawsuits as there are, healthcare prices would drop dramatically if the government put restraints on the lawyers crowding the doctors offices.

Should the statute of limitations on malpractice cases be extended?

im doing a research paper for my school and the question i was given was should there be a statute of limitations on malpractice suits, well there already is, so i revised the topic to, is it fair? and i just wanted to hear what some people think on this topic.
