Nonpayment On Car Loan

Postby Eifion » Fri Jun 13, 2014 10:52 pm

a friend of mine stopped making car payments for atleast the past 6 months. Now he has left out of state(tx) with the car to live elsewhere.A tow truck has came by and a constable brought a letter stating that he must return the car by 5pm or else they would persue felony charges. So,I am asking what charges would that possibly be?

Nonpayment On Car Loan

Most states have laws dealing with this where if a person intentionally removes secured property from the jurisdiction of the court to keep the property from being repossessed, they can be found guilty of hindering secured creditors.    This doesn't happen all that often.  Are you sure that the constable was not there just to see that there was  a peaceful repossession?  It is also possible that the constable was just talking trying to make himself sound important when in fact there were no anticipated criminal charges pending.  One thing for sure is that you can't go by the word of the people that are doing the repossessing -  they have every reason to lie to you and they do it frequently.  The people that do repossession work are some of the most dishonest obnoxious people around.   Before you get too scared of criminal charges, just make sure that you know what is really happening.
