I am 36 weeks pregnant with daughter #2 and I am scared to death.Found out a week or so ago that my OBGYN that is scheduled to do my surgery in 3 weeks (medically needed c-section,will not be allowed to try VBAC due to complications) Has a MALPRACTICE settlement case from 2009 in another state. He is with a group of doctors and I like him better than any of them!? :( I am scared and do not know how to go about asking him.I am too nervous to do so in person,if I call what should I say or who should I speak to?!? MOMS HELP ME!

Doctors get sued for malpractice ALL the time. It is usually the insurance company that settles, to avoid the costs of a civil trial, which they can never recoup even if the doctor is found blameless. You cannot infer guilt or incompetence from the existence of a settlement.

Ob-gyns are sued more often than other group, which is why fewer and fewer gynecologists are delivering babies anymore. They can't afford the malpractice insurance anymore. One day obstetricians will be extremely hard to find, and everyone will have to use midwives. Then the lawyers will go after the midwives.

If you want to know about the malpractice suit, you're going to have to ask. A settlement usually includes a non-disclosure agreement.

Or you can just go with your instincts. C-sections are one of the simplest surgeries to perform. If you think he's competent, trust him.

you are the only person who decide who will take care of you, sometimes those lawsuits are just to get free and easy money but sometimes are real situations, remember is your daughter's life and yours the one is gonna be on his hands and you have the right to change that, if you don't feel comfortable with him don't let him b your OB, on the other hand, there is nothing better than saying the truth speak up lady!!! you need to be brave and expound your reasons for changing doctors...
