Discuss the legalities of Bankruptcy Law

Oil Company

Postby Dustyn » Wed May 14, 2014 9:05 am

Hello, As a senior trying to conserve I have been telephoning home heating oil companies to get the best deal for the winter.
One had me believe that their's was the best rate and after much frustration told the lady that I would go with her offer.
Two days later another fella offered me a much better deal and I called the first people and canceled and asked if they could go lower? They never returned my call.
A few days ago the lady that I initially talked to called me and said that she was on vacation.
I told her that I found a lower rate and that I do not want to go with them.
She became very hostile and said that I have to because she tape recorded me agreeing to go with them and they will take me to court and I will have to pay for their attornies fees. I tried telling her that I did call to cancel but for some reason no one recorded that.I don't want any oil delivered in October from these people! What can I do to stop them from harassing me?

I'd start there, assuming that oil providers fall under that agency's regulation.
There's usually some sort of dispute resolution service. Was the agreement just for the winter? Was the contract worth more that $500?A contract that lasts longer than a year and a contract for goods worth more than $500 usually must be in writing.I suspect this wasn't for more than a year, and I have no clue if home oil is included within the definition of 'goods.'

Don't be getting into agreements within the phone."She turned really aggressive and stated that I've to since she tape-recorded me accepting to-go together..."Im, accepting to-go together for just how long? And did this registered discussion address termination conditions, etc. you could not stop without their contract? Did any concept show that the telephone call might be documented?? Or even and he or she did not get your permission, then I Would note to her when she did this, it had been a prison. Quite simply, I Would tell her to "take it on." "... And they'll get me to courtroom and that I will need to purchase their attornies fees."Junk. I'd create towards the mind of the organization and protest about that woman."I tried informing her that used to do contact to stop however for some cause no body documented that."You Are accepting that you were documented within the first-place (or, even when therefore, that it had been completed legitimately), it seems."exactly what do I actually do to prevent them from bothering me?"They are not bothering you... However. I would deliver a professional mail notice (and display onto it that the backup also went via normal email) to mind of company outlining these occasions and repeating that used to do not come right into any type of long term agreement which on X times I ended the purchase to provide by B date.

In PA tape recording the conversation without your consent was illegal and could subject those idiots to criminal prosecution.See:http://www.rcfp.org/taping/You might quote the statute in your letter as well.

Our discussion using the gas company. Woman made me believe that she was my closest friend, referring to my children and grandchildren like she cared! I'm like this kind of idiot, all of the chat was only to obtain me to trust her to create a sale.I have no idea what she spoke me into and have not obtained something within the email. I believe after I named it stated that I'd be documented. While she named yesterday and explained that she was on holiday, I wonder? In my opinion that she understood that I'd named to stop and was allowing time-pass where she might contact me and state that she never obtained my phone which I'm destined legally to purchase gas from her company!

I would additionally "cc"/carbon-copy their stateis consumer-protection company and also the attorney-general's workplace on that letter. And ensure that you get any purchase data/agreement info written down with any organization you deal with. Make certain it addresses termination conditions, termination notice, provides you with versatility to stop the support anytime, etc. When The agreement does not claim these specific things, then make certain it will... or do not sign it.

Laymans consider:I don't think PUC has any authority over retail gas revenue in PA.Whether they'd a notice about tape isn't obvious and that Iam not on PA saving regulations--but examine up before you leap to findings about 1 sided recordings. If that you don't send them cash plus they do not provide you gas I neglect to observe where they've a pursuit in losing time in Pennsylvania small calims surfaces--its a nobrainer for you really to drive a do-over in PA from such choice anyway.Tune out this lady, quit speaking with her.Send them obvious brief written instructions NOT To provide--WITHOUT ANY story --maintain a duplicate --discover what goes on...
