One of my tenants is using a false last name?

she is using her bf's last name and i'm concerned if my property gets ruined how would I have legal recourse over her if she is not properly listed on the lease. His name is correct but he's the lazy bum who doesn't work so it would be pointless to sue him if need be. She's the one that came out looking and one that I dealt with on the application and at first she didn't even want to list him. I didn't know she used his name instead of her own on the lease. they signed it mr sonso and sonso Beal. It's almost like my lease with her is null and void, right? would I be able to evict her if this is the case "IF" she is not willing to do a new correct lease? if they decided to get married to correct the issue, I'm concerned that even if they weren't married at the time of signing that the lease is still not valid....any advice would be great. Thanks in advance

Just in case she doesn't validate the lease would I then be able to evict her?

Varies by state law. In some states, you can use any name you want. Besides, how do you know that's not her "real" name? They may be common law married. She may have changed her last name to his. I think you're overthinking this.


Do you have her correct Social Security number? That's all you'd need to file any lawsuit.

You can come after her based on her SSN. You can sign your name with an X and as long as the contract holder can prove she is the one that put the X on the line, it is a valid signature.

Ways to avoid this in the future is seeing a copy of her SS card with a picture ID.

If you are in a common law marriage state, they might be legally married.

You have her SSN, correct? You checked to make sure she was who she said she was? Kind of on you for no BG check.

If she is unwilling to do the lease correctly, then she has no lease and you need only give her 30 day notice to vacate.
