Tonight I had a ticket that I entered into the computer, and one of the items was wrong. When the food started to be plated I noticed that one of the orders was wrong and notified the kitchen.I then had a manager come up to me and inform me that I now had to pay full price for the plate cause it was wrong. Where does the law stand on this happening? I live in TX and I am not sure what my rights are pls help.

The Texas Payday Law provides that wages may be withheld only when the employer is authorized to do so by law, required to do so by a court or has written authorization from the employee for the deduction.

This is not legal and you have the right to file a claim with workforce Texas to recoup the funds withheld illegally.http://www.statutes.legis.state.tx.us/Docs/LA/htm/LA.61.htm

Texas Payday Law section 61:018

Sec. 61.018.  DEDUCTION FROM WAGES.  An employer may not withhold or divert any part of an employee's wages unless the employer:

(1)  is ordered to do so by a court of competent jurisdiction;

(2)  is authorized to do so by state or federal law; or

(3)  has written authorization from the employee to deduct part of the wages for a lawful purpose.

Acts 1993, 73rd Leg., ch. 269, Sec. 1, eff. Sept. 1, 1993.
