Paying Off A Judgement In Ny

Thank you for your time, but I have never asked this question, and I read almost EVERYTHING on the board.  I appreciate your time in answering my question!

- My husband has a Judgment for a CC, and have been paying them off $75.00 a month for several years, and the amount is down to just over $2,000.00.  They called today and said if we do not pay the FULL Amount they will put a lien on my husbands earnings, and a hold on his bank account.  

I can NOT pay it all off for another 3 or 4 months, we are ALMOST done paying all of our debt off but until then things are tight.  They said AMEX was the one who said they wanted it all, I offered to send $300.00 now and pay the rest off by the end of the year, but they only wanted the full amount.  I don't want holds on our accounts - can they DO this while we are paying an agreed upon amount monthly?

Please accept my apology, as I receive thousands of emails and obviously yours goy classifies in the wrong area!

None the less, thanks again for wrinting to me and I am happy to be of assistance to you.

Now, lets take a look at your situation.

You said that your husband had a judgment placed against him in 2000.  I am going to expect that the judgment was the result of a legal action that was the result of American Express hiring a collection company and they then sued him?

So he then starts making 75.00 payments toward the obligation on a consistent monthly basis.

See, I am not sure the the demand that you received for the payment in full came from American Express, as they have a hands off policy as long as the account is in a paying legal status.

If I were you, I would continue to SEND THE 75.00 DIRECTLY TO AMERICAN EXPRESS. Do not send the collection company the payment.

At the most, send them copies of the MONEY ORDER that you send to AMEX.

Keep paying on the account and if they continue to demand more, let me know and we will profile them on our site at www.mycollector.com.

Yesterday, I had a collector that was collecting FOR AMERICAN EXPRESS with NCO, tell the debtor that he would us the CRIMINAL PATRIOT ACT AGAINST HER IF SHE FAILED TO PAY, needless to say, that is going to cost AMEX 10,000 and 10,000 to NCO.
