Personal Injury

Postby Nawat » Thu May 15, 2014 12:53 pm

My husband(Mark) and I were in a fender bender on Dec. 1st, 2009.  We were stopped at a red light when a car hit the car behind us slamming that car into our car.  We weren't hurt badly, but had some neck and lower back injuroes.  Mark went to the doctor and therapy for about 3 weeks and I went for about 4 mounths.  Mark was offered a settlement of $2350.00 plus his medical of $1700.00 which we will probably accept.  But I(Debra) was only offered $3000.00 plus my med expenses of $5900.00.  I don't want to appear greedy, but I expected my offer to be about $9000 instead of $3000.  Should I pursue what I feel is right or should I accept the $3000 and forget about it?

Sorry, this question cannot be answered without a lot more information such as the type of medical treatment you received, what was wrong with you medically, whether you have permanent effects, whether you lose wages etc.

Best to have the case evaluated by an experienced injury attorney who can look at all the facts and advise you.

That attorney could likely reduce your medical expenses down(If they were paid by your insurer) and increase the 3rd Party offer.

If the third party put their offer in writing of $8900..perhaps you can hire a contingency lawyer to take the case on a 1/2, 1/2 split on everything over the $8900-

Good Luck,
