Is it better to refuse a pre-employment drug test or to take it and fail? I ask because some companies try to discourage drug users by stating that they test when they actually only test if suspicion arises. Secondly, do employers have the right to tell anyone (other employers within the same parent company, law enforcement, etc.) that an applicant has failed or refused a drug test?

No, they won't tell anyone. But, there is one sure way to pass a drug test. I think you know what that is. If it's a pre-employment test, it means a real test, they aren't just saying it.

Refuse to take the test and they ask you to leave and don't come back.
