Property damage Pennsylvania laws? Help!?

Postby fiynn » Sat Jun 23, 2012 11:46 am

Have a Property Law Question. 2 1/2 weeks ago, a individual mowing his property along side our driveway hit our vehicle with a rock, causing around 500.00 in damages, we attempted to flag him down and were unable. We waited the the spot of accident, and upon his returning to the spot still mowing for saftey reasons we had to move the vehicle and continued down the driveway and parked. Due to saftey issues with flying rocks, we decided to call the vehicle owner and proceed when it was safer. Following day contacted the "man mowing" and his wife. They gave and took numbers an todl tthey could call us. Later said husband to be out of town. Waited 2 weeks, half way through the second week finally contacted and told wasn't going to pay or help in any way. Now it becomes a court issue, not a problem for us. However we're going to lose time from work, court costs, and the damages and time taken from our lives to persue this in court, the question I have based on the information is there anything I can sue for aside from the damages to the vehicle. I have had an estimate worked up from the Local Body Shop I use in the area. The estimate was for 500.00 Taking the time off work will result in a 600.00+ loss of pay combined between the parties involved.
We also have a witness to the accident that does not own the vehicle.
Any help or knowledge in this area would be great! Thank you!

$600 in lost pay??? Yeah, good luck trying to claim that for a $500 small claims case. Even if you want to say that you'll have to miss a whole day of work to go to court (which you won't) that means you're making $75/hour. I doubt you're making $75/hour.

You get the cost of repair. That's it.

When I watch those court shows on TV, I often hear them say "It's not about the money, it's about the principal". I think that's nonsense. Court is about the money.

Also consider, "no one can make your life hell like family or neighbors". You don't want a fight with your neighbors.

Addition.

You could write your neighbor a letter. Say your going to sue, but does he want to settle. Give him another chance to pay.
