The condo unit that people possess experienced serious water damage and mold consequently of the fireplace within the unit directly above mine. The fireplace orginated in the dryer. It's a rental unit and the tenants put washing in and quit the premesis. Based On The fire department. the fire was brought on by an electric short in the dryer. Once The tenants delivered, they mentioned that they'd requested the landlord to get a new dryer since they were having issues with it. Your recently renovated system experienced serious water damage around the roofs, floors and surfaces. All of the surfaces have now been cut out from the rehabilitation organization. We're told we will not be living there for 6 -2 months. You can certainly "seek" whatever compensation you want.But who from?If there was a short in the dryer it's not the fault of the upstairs tenant.If you can prove that the upstairs tenants reported the defective dryer to their landlord and the landlord did nothing about it within a reasonable amount of time you MAY have a claim against their landlord.I suggest that you discuss that aspect with your insurance company's subrogation department and see if they will go after the upstairs landlord to recover what they pay out on your policy.Insurance companies typically don't hesitate to pursue subrogation when there is some evidence that another party is responsible.If your insurance company is going to subrogate you may be allowed to piggy back your additional damages on top of their subrogation efforts and get yours handled for free.If your insurance company decides not to subrogate it will likely be that there is not good evidence of the other party's responsibility. That means that you will probably be unsuccessful as well. After all, with the insurance company's expertise and money, if it doesn't see a good reason to pursue, there likely isn't any.However, that doesn't prevent you from hiring an attorney and an expert and pursuing a lawsuit on your own.
