Property on brothers n fathers name?

Hi, we have a house that we live in, my brother passed away 2 years back. My dad who is very old is still managing to pay the loan little by little, my sister in law went back to her mother, and does not take care of any responsibity , neither my old parents nor the loan , once the house is paid off, who will have the rights on that house, my dad or my sister in law ??

When your brother died his wife would be his beneficiary unless directed otherwise by a will or separate document or title registration noting that the property was to be left to the surviving joint partner, which was your father.

Firstly check who is the owner according to will. If your father is the only the owner of this property then there is no right till your father is alive. Second thing if your father had transferred his property to your late. brother then your sister in law is the complete holder of your house. It does not matter who is paying off loan amount.

Find out who's name is on the title of the house. Since dad is paying, will can guess the loan (mortgage) is in his name, but check. Get dad to make a will so he can give the house to mom, if her name is not on the deed.
