I filed bankruptcy in august of 2008. In July of 2009 I discovered that my mortgage, which I've and still spend, was never reaffirmed. After speaking with my attorney and the bankruptcy judge, they explained that within the state-of Nebraska when you create that cost after bankruptcy it automaticaly reaffirms. Spoke to Wells Fargo and they inform me the bankruptcy would need to be reoppened before they're may to complete something about any of it. I fought this for weeks and lastly droppped it after I was told numerous occasions that I was good. Therefore this summer we choose that we'd prefer to market in annually or two and start repairing our ratings, etc. and finding anything to be able to do this the proper way. Today I'm being informed that wells fargo may maintain any arises from the purchase of our house, Definitely any support or data in this issue is greatly valued. Cheers

They have a mortgage or deed of trust on the home, so while your personal liability is eliminated in the bankruptcy, their lien is still valid and they will be paid off when you sell the home.

They are entitled to the contract amount, no more or no less without the agreement of all parties.

That part I understand, but are they entitled to any equity. I owe them 67,000 , if my house sells for the 100,000 it appraises at, do they get any of it? thanks
