35yrs of x-perience. When he went to cut the spot he hit a main blood vessel artery. He also had a camera tool to use so that it shows him what's inside and so forth. So now instead of having an one ince scar I have a scar that will go all the way down to my pelvic line. I'm still recovering from it and it looks awful. My belly button doesn't even look a belly button anymore and I have a lot of pain on the outsides and inside. My question is should I sue for medical malpractice because he quote "made a mistake and unfortunately I was the one"? He's an excellent Dr. and we live in a small community and I don't want to tarnish his name but I don't feel that this should of happened. If I do sue, is there any chance of keeping it silent so that the whole community doesn't know? Thanks.

The best thing would be to talk to a lawyer.All Doctors have malpractice insurance and it could be done without causing a huge fuss.

Just because someone meant well doesn't mean they aren't responsible to make up for their mistakes, no matter how respected they are or what the damages they made were. Yes, sue him, and I really admire you for keeping it quiet to respect his good name. You deserve to be compensated for your extreme loss and emotional and physical pain. I am certain the best lawyer around will want to help you since your case is no problem. If you destroyed property of the doctor, I am sure he would tactfully sue you as well, and it wouldn't be personal... lol

You could do a medical malpractice suit, but be for warned, you would have to get Dr.'s from out of state to testify against him, be able to prove malice, and it would get listed with the AMA. It can take years and years of pain and anguish to gain nothing. Whatever you could win in a settlement would be eaten up by paying for expert testimony. I know it is hard to be the "mistake" but is it really worth taking it to court to try to get some sort of monetary reimbursement? I tried and it was going to be a lost cause because Dr's do not want to testify against the brothers, I had cancer that went undiagnosed and had to undergo a 2nd surgery because of it. Now i have a very unsettling scar on my throat for the entire world to see. 3 lawyers were unwilling to accept the case. Medical malpractice is very hard to prove and there is a statue of limitations. Get a free consult with an attorney to see if it would be worthwhile to sue. Good luck!
