Shoplifting Charge

Postby Verne » Sat Jun 14, 2014 10:13 pm

I was recently arrested for the first time ever for a shoplifting charge. The total of the merchandise was about $75.00. What are the chances of the retailer dropping or dismissing the case since the amount was under $100.00. And this was listed as a Class C misdemeanor. Will this go on my record since I had a clean record up to this point?

Shoplifting Charge

Julia,

The crime is not against the shopkeeper or his store.  Its a crime against the state so the prosecutor is the one who decides whether to take your case to trial.  You will definitely need an attorney because right now you have a criminal record for theft and from here on you will have to answer "yes" whenever asked if you have ever been arrested.
