Should I bring this to a small claims court?

Two years ago I bought an iPod with a three year warranty at Wall-mart about a month before I was going to start college. The total price of everything was $315. At the time and still currently my sister has this boyfriend who has a crime history. One day when I left my room when he was the only one at the house, he stole my iPod with the warranty, which was in my room. However, I did not know he did this because I thought I had just misplaced it at the time, so for a month I kept looking for it. After I started college, I heard he admitted to stealing it from my mother. I haven't done anything to him except behave pissed off when he comes over for the last year and a half. My question is should I bring this up to a small claims court? I do not have any proof that he stole it other than my mom telling me that he did. The receipt of the purchase and the iPod with the warranty information was all in a bag which was stolen, therefore, I'm stuck on whether or not I should bring this up to a small claims court, so I can get my $315 back.

The first thing you should have done is ask the police if this is a petty theft or a felony, based on the dollar amount of the item (s) in question; once established, if able, have them check your State's statute of limitaions to see if the crime is still punishable by law. OR, see if Mom can talk to him about repaying you for it. Trust in God for His assistance. With men this is impossible; with God, ALL THINGS ARE POSSIBLE!
