I received workers compensation for medical. I want to get a cash settlement and agree not to pursue a lawsuit for the permanent lumbar injury I have received. I cannot afford the retainer for an attorney. Do I approach HR about a settlement? I live in MN and the accident happened at my employer in ND parking lot. A year prior to my injury another employee slipped in the same spot and busted his leg badly. Please can you give me direction?

Toni,

I am sorry to hear about your accident and injury.  I hope that you have a good recovery.

I practice exclusively in New York State.  I am not familiar with the law in Minnesota or North Dakota so I cannot provide you with any legal advice in this matter.

However, under New York law, workers’ compensation is an exclusive remedy; that is, if you are entitled to collect workers’ compensation benefits, you cannot sue your employer or any co-employee for any injuries that you sustained.

I would suggest that you speak to a lawyer – in both Minnesota and North Dakota – so that he or she can advise you about any legal remedies you may have.  Feel free to contact me directly if you have any further questions or you need a referral to an attorney in your area.
