George,
I am sorry to hear about your injury and the ordeal it has caused you. If I understand your question correctly, you injured your back due to an incident on the job while working for Wal-Mart. This incident occurred in 2006.
You do not say where you live, so I do not know which state laws will apply to your case. I practice law in New York and can share my insights based on New York law. Unfortunately, I cannot offer an easy solution. If you were injured on the job, then you should qualify for Workers' Compensation. While Workers' Compensation would pay for your medical care, some of your lost wages and some other losses, it also prevents you from suing your employer.
As a result, if you live in New York and are hurt on the job, you cannot sue your employer.
You also say that this incident occurred in 2006. In New York State the statute of limitations gives you three years to file a lawsuit in most negligence cases, though it can be shorter depending on the type of case and the if it is a municipal defendant. Because so many years have transpired, it is too late to file a lawsuit. The laws may be different in your state, but I doubt that the statute of limitations would run so long as to allow you to file suit over a five year old incident. I hope this information answers your question.
