I'm assuming you have proof of purchase. Take a picture of both the rug and the proof of purchase together with the time stamp on the camera. This will show the rug is damaged at least by the date on the camera. Every state in the U.S. has passed the Uniform Commercial Code on Sales, which states that when you buy something the seller has made certain warranties. One is that the goods will conform with any model or sample that is on display. Another is that the goods shall be merchantable, which means you should be able to sell yours. You can read this if you like at this web site:http://www.law.cornell.edu/ucc/2/article2.htm The rights you have under this law are enforceable by law, but when it comes to a rug, you would probably need to try non-legal remedies first, like going to a consumer help line operated by a television station or newspaper. Next, I would try calling the state attorney general's office and asking if they have any help for consumers who have been defrauded. If you still haven't been successful, at that point I would think about going to small claims court and suing the rug company. You would need the evidence that you have (the photos) and it would help if you had a friend who has seen the rug from the time you bought it or soon thereafter and can testify for you that it was in that shape when you got it. I hope you find luck. It may be that if you wave that law around in front of the face of the rug dealers, they will give you a new rug. Sometimes seeing that you are really serious does wonders.
