Sue for Medical Malpractice?

My doctor blatantly lied to me about my CMV test results. He was against me taking the test to begin with and against me using any donor that was CMV positive. I really wanted to use this donor that was CMV positive, but I told my Dr. that if I was negative than I wouldn't. I got the blood work and he called and said that I was negative. Today, I discovered that I am positive. Do I have grounds for legal recourse?
