Dear Mr. Paisola,

I finally feel a glimmer of hope after finding many questions directed to your regarding Tahiti Village.  My wife and I purchased the best(most expensive) unit the development had to offer.  We couldn't afford it, but believed we had equity available to fund through a second mortgage.  

When we got home we got cold feet, and sent in our cancelation paperwork.  There was no disputing the timelines, and we were off the hook.  But the sales manager that had become our new best friend, Bob, called us multiple times every day, suggesting that we reconsider--he didn't want us to lose out!  Believe it our not, after he got a price reduction "approved", we agreed to sign again.  Papers were overnighted to our home, and Tahiti Village paid the notary service to hook us again.  

Even though the 2nd mortgage was approved, a number of other urgent financial needs presented themselves, and I found myself stuck with paying the high interest payments for the in-house financing.

I have offered a Deed in Lieu of Foreclosure, but they claim they are not licensed to purchase and resell property.  I told them I could no longer pay, and after missing two payments I began getting frequent phone calls asking for payment.  Most of these calls were received by my wife, who has chosen to be a stay at home mom.  The whole situation has been extremely upsetting for us, but especially her.  When the lender threatened to garnish my wages, my wife saw no option but to agree to their terms.  They gave us two months break from the payments, but added them to the principle balance of the loan, if we would catch up the past due immediately.  My wife called my mother and begged for help.  Dear sweet Mom covered the payment.

I have been trying to sell the property for around 5 months, with no offers for more than 20% of what I owe.  The payments start again next month, and I still owe more than $31,000 on a property that I agreed to purchase for $35,000.  We put $5,000 down and have paid approximately $6,000 in payments to date.

One interesting fact I discovered in my paperwork:  we purchased Tahiti Village Phase II.  When I looked up the parcel numbers listed on the conveyance document on the Clark County records map, they were not part of Phase II, but rather an adjacent parcel to the development.  The map clearly shows the parcel numbers for Phase II, and ours is not there.  Could this help us get out of a bogus deal?

In all honesty, I still think the property is beautiful, but we were pressured into buying something we couldn't afford, and now that we are forcing out the payments there's no way we could ever afford to go and enjoy it.  

Please tell me you can help us.  This situation has added so much stress to our lives that divorce has become a common topic, and I have given serious thought about paying the debt with my life insurance.

First of all, I want to thank you for taking the time to write to me on this issue. You would not believe the mail that I have received from around the world at my corporate email address about this property-Tahiti Village/Consolidated Resorts. I am glad that you are telling me that the Clark County Recorders office has issue with the Phase II paperwork that you were given. Something is just not right here.

Now, lets look at the reality of this issue. This property used all the sales methods available to push you into this contract. They even provided a notary so that you could not rethink the cancellation save that they got from you.

Next, this is a VACATION PROPERTY. If it is such a great place, then why in the world would it be causing so much stress on you and your wife that you are looking at divorce.

This is complete bullshit, and to all of my readers around the world hear me loud and clear. DO NOT BUT A TIMESHARE !

Now, Here is the reality. They have pushed you into this transaction and that is very easy to prove and you have been OVERSOLD.

So, to all of the sharks at Tahiti Village, you boys had better take care of this man, because there is way too much going on in the back rooms to even begin to start on this forum.

Tim, DO NOT PAY THEM A DIME. Let them call and tell them that until your INVESTIGATION ON THE DEED ISSUE IS COMPLETE there will be NO payments.

I would love for them to sue you, because we would turn this into one of the biggest class action lawsuits ever.

I am going to look into the deed issue and if you were given a bogus deed or if the financing docs were bs, then we will take this all the way.

Again, DO NOT PAY THEM and tell them to do what they have to do, if they sue, I want to know immediately, as we will issue an international press release and have CNN at their doorstep.

Then we will see who is screwing who.

Let me know.... and to think that I am in Orlando Florida today doing a timeshare sales training for the DISNEY COMPANY... I am going to use this at my presentation tomorrow.  Boys, when you cross the line, you are done. Sending the notary..... god help you...

Thanks for the advice and the encouragement.  I will be discussing your rx with my wife.  You asked me to let you know how things were going, and you said you would be looking into the deed issue.  Is there a more direct method that you may prefer to exchange info on this issue, or is the AllExperts.com your preferred forum?

Originally, i just hoped to somehow just get out of this deal, but maybe I could even get some/all of my invested money returned as well.  What do you think??  I have better ways to use it!
