No lease rent is paid month to month. Unfortunatley im usually 1-2 weeks late but rent is always paid. I try to pay on time just always seem to be behind no matter what I do. I have 3 children ages 4, 3 and 4 months so I always have to make sure I have enough money for the week for food, diapers, gas, formula etc. Apartment is not the greatest and lots of things need fixing landlord rarely fixes anything and never stops by not even to collect rent, he makes his 82 year old father do it. Sad part is landlord is my uncle who I probably will never be speaking with again now. How much time do I have to move out and can i prolong it by saying I want a court order?? I cant seem to find anything online everything i read is for NYC im in Upstate NY. PLEASE HELP IM SO STRESSED

Without a written lease, there is a month to month tenancy
That is a lease, governed by state law and commonlaw
You need to take control of your life, your situation
Your FIRST obligation is to provide a roof over your children's head
That means RENT should be paid IN FULL and ON TIME
None of the other stuff matters AT ALL. . . .you regularly pay late. . .you are always behind. . . .you have more children than you can provide for. . . you are violating your lease, your month to month tenancy. . . .
A LL does NOT have to stop by, does not have to pick up the rent

If you don't move out when given notice, then the LL goes to court, and when you have NOTHING on your side, the judge will order you out and give uncle a judgment for back rent and court costs, etc. Yes, it will take a little longer to get a court order, and then you will have not only a BAD LL reference, but an eviction on your record, added to inadequate income and 3 young kids, and it will be VERY difficult to find a LL willing to take you

Are you receiving child support? have you gone to court to get the babydaddies to provide for their children?

Your uncle is going to evict you? What kind of family is this?

There are plenty of websites relating to NY state eviction law
