ANSWER: Dear Ayinla,

The Canadian High Commission in Lagos, Nigeria refuses most of the Temporary Resident Visa(TRV) applications it receives. In 2008, the visa application refusal rate was 63%(5448 refused, 3069 approved).

There are two ways to contest a negative decision:

(1) Make a new application and provide additional evidence of your ability to satisfy Canada's visa requirements. This should only be done after first obtaining a copy of your electronic file from the visa office in Lagos, because this file should provide a detailed account of the reasons for the negative decision. Only a Canadian citizen or resident of Canada can obtain a copy of such a file.(2) Hire a lawyer and apply for leave to appeal the decision before the Federal Court of Canada. This would be a costly undertaking with no guarantees of success.

TRV applications are often refused because the applicant has made mistakes or failed to understand what the officer was looking for. In some cases, it may simply be impossible to satisfy the visa requirements.

If I have been of any help, I would invite you to complete the AllExperts rating form.

Best wishes,

Applicants outside Canada are not entitled to obtain their electronic or CAIPS file, but they can authorize a Canadian citizen or resident to act on their behalf.

If you would like me to act on your behalf and obtain a copy of the CAIPS(or electronic visa application file) and let you know my professional opinion concerning the case, please contact me directly.
