Anybody help , as this has got me stumped! If an employer is in breach of implied term of mutual trust and confidence by abusing a flexibility clause in an employee's contract.( through no consultation and very short notice on introducing a change in working patterns ) and the employee refuses to accept the change and simply wants to work original work pattern . Can the employee do this? i.e. work on as per their original work pattern if all the other employees have agreed?
