What constitutes breach of contract?

Postby blaeey » Mon Nov 21, 2011 11:25 pm

If a pianist slipped and broke her wrist (due to no fault of her own) and could not perform in a concert, would that constitute breach of contract? Would the outcome be any different under scottish law?

The pianist's argument would be that her contractual obligations are excused under the doctrine of impossibility. This goes back to Taylor v. Caldwell, which should be in your textbook.

No, there is a 'reasonable' reason for her not performing
