Having a dispute with a tenant or landlord? Rental Law discussion

Virginia Rental Laws?

Postby tonibraxton » Mon Apr 04, 2011 10:10 pm

What are the rental prorate laws in Virginia? I will be moving into a new apartment on January 15th and the landlord is trying to charge me from January 1st, even though I will not be occupying the place for 15 days. If there is legal documentation stating that the landlord has to prorate the rent, can someone tell me where to find it. I've tried looking on the internet and cannot find anything other that what people say, and these real estate agencies don't want to answer my question because I'm not using their service.

Usually you pay the first months rent in full when you move in and then the second month is discounted for the days from last month.

There is no law that the landlord has to prorate rent though, the above is simply how it is usually handled. No decent landlord will rent without first months rent.

There no laws which require that a landlord pro-rate your rents. This is a CONTRACT issue, and you need to refer to your lease agreement. If you have rented as of January 1, but do not intend to move in until mid-January, you have no basis to demand or even ASK for any sort of proration.

What did you two agree to? Did you two agree that you would pay from Jan 1, or from Jan 15?

In other words, you won't find any laws. This is a matter dictated by your contract, i.e. lease agreement.

It doesn't matter when you move it. It matters when the lease starts. What does the lease say?
