What are the nys rules to reinstate a workers compensation policy for non payment of premium?

Postby tahmelapachme33 » Sat Dec 17, 2011 9:12 am

Workers compensation policy received notice of non payment cancellation effective 10/27/2011. An employee of the agent sent a email advising of the cancellation and stated payment must be made by 10/14/2011 in order to reinstate. My argument is if the payment is received prior to 10/27/2011 the policy must be reinstated.

Not true.

The insurer actually has NO obligation to reinstate the policy if the payment is received after that cancellation notice is issued.

It's not at all like car insurance, where you can play payment games with the cancellation notice. The insurer wants to have enough time to verify that the check you give them, isn't going to bounce, BEFORE they reinstate that policy.

And normally, if the account is "late" more than three times, the insurance company will stop offering to reinstate. When the policy renews, expect to have to pay the premium in full, up front.

If the 27th was a typo/mistake, a case can be made to reinstate unless the email stated that the 27th was a typo/mistake and payment must be in by the 14th. If they corrected their mistake, then it needed to be in by the 14th.
