What can happen if the SSI finds these people gulity of SSI fraud?

Postby sylvester37 » Tue Jun 12, 2012 12:03 pm

So, I reported my soon to be ex husband, his mother, and father for SSI fraud. What they did they are robbing from the government and using people tax money. They are millionaires mom a law professor and dad is a retired surgeon. My soon to be ex, was getting about 150 to 200 a month under the table from his mom. Your only supposed to have a certain amount in your account if not then its illegal. Also he has a credit card he opened in his name and owes them a lot of money. You cannot have a credit card with SSI. His dad gave him 700 a month for student tuition. He opened his own online business. you cannot do that on SSI. And he owes my mom $1600 in undue rent money and over $800 in car repairs. And he had some money and he used it on himself. plus his parents wired money in his bank account. So, the SSI representive said from what I told them they do not think he deserves it either. And, they are getting an investator to look into it. What could happen if they are proven guilty? Could they get all get a fine, have to pay the money back, or go to jail? What could happen?

Nothing is going to happen. This is a very, very low level of fraud. It is unlikely social security will devote too much time to this. In the unlikely event they find he was overpaid, he will simply be required to pay the money back . . . something I'm sure his parents will do. There is NO claim of fraud with regard to his parents. Parents are allowed to give their children money. Their son is the only one with any legal duty with regard to the SSI.

BUT . . . I hope you realize that you could find yourself in some criminal trouble yourself. How long were the two of your married? Did you file taxes jointly? Were you claiming the nearly $2,400 per year income from his mother? How about the money they wired? Were you claiming the business on your taxes? If not, the two of you could BOTH be in some hot water with the IRS. This is far and away more likely than anything happening to him over the SSI.

Possible jail time but I highly doubt it since they are supposedly rich enough to get them some excellent lawyers. They will have to payback what was taken and also some kind of restitution fee. You say he's soon to be ? Does that mean he was collecting while you were still together? Hmmm... It also doesn't matter of his father was a surgeon and his mom is a teacher. So long as he worked at a job that qualified for SSI and Isn't able to work anymore and since he's married his wife gets a check too

Since all you sound like is a vindictive ex wife, I'm sure SS didn't even take your report seriously.
His mother is free to give him money if she chooses to do so.
You most certainly can have a credit card if you are on SSI.
Nothing illegal about his father paying his tuition.
He can have an online business as long as he is claiming his earnings to SSI.
What he owes your mother means nothing.
So what if he had money and used it on himself....it is his money.
His parents can wire money into his account as long as he isn't over the asset limit.

Be careful what you wish for.....if you were married to him while this was going on, you could be guilty of fraud too.
