What happens when you get a reckless driving ticket in Virginia?

Postby motega » Fri Mar 16, 2012 1:36 am

I'm 16, I'll be 17 next month when I have my court date. This morning I hit the metal post in front of the gas pump at a gas station. It ripped off the front of my fender, but there was no damage to the post or to anything else, no injury for me. I was pulling in to get gas and my tire hit something and I tried to turn and hit the post. However, the police were called. A 'witness' claimed to see me on my phone and then leave the scene, however another person was trying to help me find my phone which was in the back seat somewhere so I could call my dad. The gas station security camera (if they go and look at it) will show I never left my car. I walked around it to see what happened and then got in to my car to call.

I was going maybe 8 miles an hour as I pulled in, not speed, nothing. Somehow I still got reckless driving as opposed to failure to maintain the vehicle. We've talked to our insurance and even they feel that the office was in the wrong and everyone plans on going to court/the police to have the charge changed to something lesser.

If I do get convicted of the reckless driving, what happens? I had one ticket once, a speeding ticket when I first started driving for going 12 over but it was dropped and removed from any files/permanent record and was erased.

If I get failure to maintain vehicle, what happens?

Also, what am I best off doing now? Hire a lawyer, what? My parents are taking care of it but I want to know what's best to do.
