Disregard the previous answer. The Avandia litigations are not "class action lawsuits." A class action lawsuit means that everyone involved gets the same thing no matter what. MOST Avandia "class actions" are actually 'mass torts.' Settlements are going to be unique for every case, every claim, depending on severity of injuries - Cardiac death being the worst (obviously).
My experience: Our firm is representing over 2000 clients against the makers of Avandia, and we are very close to SETTLING with GlaxoSmithKline - I guess you could say that we can FINALLY see a light at the end of the tunnel! Don't get me wrong, settlement negotiations are going to last a good 6-months. All I know is that we don't want to drag out the settlement, like they have been in the past (ex. Vioxx) because the people we are representing are sick and don't have a whole lot of time. Plain and simple. We should be issuing checks in less than 12-months!!
For anyone who thinks "Wow, what a long time!" No, no that's not!
Oh, and above said the lawyers could take up to 75%! That is a blatant lie. The average across the board is 40% contingent fee. Did you know we spend $30k A WEEK on ordering medical records for our Avandia case?!
GSK has settled somewhere around 10k-15k cases. Atleast an additional 15k claims are pending. Between Avandia and Paxil Birth Defect Lawsuits, GSK will be paying out well over $5 Billion.
There are not hundreds of thousands involved the the "Avandia class action lawsuit."
Do not borrow against your settlement. That would be the same as taking out a Title Loan. It's crap
