What would the person be charged with who tried to shoot one person but killed another who jumped in the way?

I'm writing a book and I need an answer. I have a character that was killed when he tried to push someone out of the way of a gunman but took the bullet instead. My question...what would the gunman be charged with? Criminal Murder? Felony Murder? Voluntary Manslaughter? I'm a bit confused on the law here... lol Thanx in advance...
