When is it to late to sue ?

So I was in the 6th grade when I got lasik eye surgery in my left eye. My vision was blurry but after the surgery I lost my vision. I dont know when I lost it, I had an eyepatch covering my eye so it was impossible for me to know. What I do remember is the doctor giving me a 5 dollar bill....anyways its been 8years since that happened. I never wanted to sue mostly because I left that up to my dad, and I didn't really know what was going on.

i know its most likely late to sue but when would of been the right time to sue.
And I also didn't want to sue because I honestly dont know if it was a medical malpractice or somehow my fault.

this depends on your statues of limitation for this case.

also, did you or your parents at the time sign any paperwork stating they understand the risks of the surgery -- which could include blindness? if so, then you have no case against them.

you also chose at the time to leave it to your dad and if he felt that you had a case i bet he would have gone through with it.

i honestly dont think you have a case anymore.... if you even had one in the first place.

It depends on your state laws. Most states have a 2 year statute of limitations. However, as a minor, you may still be able to bring a cause of action up until you reach your majority. That said, your parents would have to be the ones doing the suing if you're still underage, and you would definitely need an attorney.

Just because you lost your vision after having surgery doesn't necessarily mean you have a malpractice case.

Your parent or guardian could have sued if there were medical malpractice and you suffered a loss as a minor. Did you ask your dad why he took no action.

It is likely too late. The only way to find out what legal options are available is to CONSULT YOUR ATTORNEY. If you need an attorney, use the local lawyer referral service or the one at your state's bar association website.

It is likely too late. The only way to find out what legal options are available is to CONSULT YOUR ATTORNEY. If you need an attorney, use the local lawyer referral service or the one at your state's bar association website.
8 years is certainly beyond the statute of limitations in most states, though we don't know where you are. You probably only had from one to three years to file any action.

The answer will depend on too many things to get it right on Yahoo. The best answer for your particular circumstance is going to come from a local attorney specializing in malpractice.
