When we get married, does he now have access to all my money??? please help!?

Postby claudius » Sat Jan 13, 1979 2:24 am

Help! I need advice from someone who is knowledgeable about laws! (marriage laws?!)

First off, I am getting married because I got pregnant. (yes it was an accident, but I have decided to carry through with my mistake.) and it has always been my life expectation to be married when I have a child. (integrity, family values, etc). So when he proposed, I said yes.
If I end up getting divorced, I accept that. But at this point it is something I feel that I need to go through with to fulfill certain expectations I have for my life.

The situation is that he has NO money, no bank accounts, no car/ valuable property.
he is on general assistance in the state of california, and has been out of work for a year.

I have a bank account with about $5,000 in it, that I have been saving up from my dry cleaning delivery job. and i also have a car, (an older car with about a $3,000 value.)

My question is; What exactly happens to my money and possessions when we get married??
does my money and possessions now belong equally to him????
Could he legally use my money, access my bank account, or use my car??
does everything that is mine become his as well?

If so, how do I go about filing a prenuptial agreement? and how much does it cost?

I realize that I am not getting into an ideal situation, but something that I am still going to go through with. At this point, I am just concerned with protecting my possessions and bank account.
The wedding is on the 21st of december. what steps should I take now, to protect my assets?

It's up to both of you to join your accounts into one. Your account is yours and his is his. He can't touch the money unless you were to join bank accounts, give him an ATM card, or get divorced.

He needs to get a job, a decent job to afford your child, to pay his child support whether or not you stay married so if he doesn't have a job before marriage then he probably won't have one after marriage (he's probably marrying hoping you can support him, but you can't), so put off the marriage.

Sure you can file a prenuptial agreement but I think the law in CA is that all assets are split down the middle so if you marry and then divorce tomorrow he gets half of what you have whether or not you have a prenup. So, put off the marriage till he's better prepared. You can still collect from him child support when your child is born, merely save some dna (fingerprints, hair strands) from him as proof the child is his.

The money the car are yours. He cant touch your bank account his name must be on the account and by law you do not have to add it. Any thing accured after the mairrage could be split in half if the mairrage is disolved. Times change you sound as if you would be just fine by yourself, many woman are sinigle mothers and do better than some familys and at times it is best for the child.
