Who can tell me what the Minnesota state law is here? Can i call the police after 30 days to escort them out?

Postby hewlett » Wed Oct 26, 2011 1:22 am

have friends staying with me. I am the homeowner and they have been staying with me (family all sleeps in the living room) for almost a year! I finally gave them a written 30 day notice to vacate and they agreed and we all signed it. Now Im afraid they are just thinking I will let it go...I have for too long already. So if the date comes and they are still just sitting in my house and I call the police will they MAKE THEM LEAVE if I show them our written agreement?
they DONT pay any rent and are not on any lease or written agreement to stay.
*ps do they need to SIGN the 30 day notice I gave them to prove they did see it?

They are not tenants, they are guests. Once a guest is no longer welcome you can simply ask them to leave. If they do not leave when requested, they are trespassing and can be arrested and removed by the police.

On the other hand, the fact that you even gave them a written notice is evidence that will be used against you as proof that you considered them "tenants" who are protected by various state laws. You could get sued if you do not follow each and every point of the MN landlord/tenant act, assuming they don't leave voluntarily.

You can certainly have a "written understanding" between friends, stating that they will leave on a specific date, for your mutual coordination, but you have the legal right to remove them immediately. If you do write, avoid any suggestion of landlord/tenant, rent, eviction, notice, or the like.

Also, avoid any suggestion that they have any choice in the matter; do not say that they are giving you anything of any value in return for staying there at any time, and do not have any "what if" provisions that go beyond your willingness to cooperate with their staying for a few more weeks.

No. You need to go to court. The police will just tell you to do this.
